Mason LLP filed a Class Action Lawsuit against OakBend Medical Center (“OakBend”) on November 17, 2022. OakBend is a nonprofit hospital located in Texas that has been providing healthcare services to the Greater Houston Area since 1947. It employs over 450 physicians along with 1,200 other staff members. On September 1, 2022, OakBend found that cybercriminals hacked into OakBend’s computer systems and removed the entire medical record of patients and certain employee data files. This breach has affected over 500,000 people.

Mason LLP filed a Class Action Lawsuit against Salud Family Health, Inc., (“Salud”) on November 14, 2022. Salud is a nonprofit healthcare provider located in Colorado, which was the target of a data breach. This breach resulted in employees’ and patients’ Private Information being exfiltrated and now in the hands of cybercriminals.  Salud sent out notice letters to people affected that their Social Security numbers, driver’s license numbers or state identification card numbers, financial account information, credit card numbers, passport numbers, medical treatment and diagnosis information, health insurance information, biometric data, and usernames and passwords may have been accessed and stolen. Salud failed to have adequate data security for its computer systems, so cyber criminals could easily access the Private Information of many people tied to Salud. Data breaches make it easier for those affected to become victims of identity theft and fraud. They will have to spend time and money now and in the future to mitigate those risks that could have been avoided.

Mason LLP was the first of several firms to file a Class Action lawsuit against Convergent Outsourcing, Inc., (“Convergent” or “Defendant”).  After receiving a notice of a data breach from Convergent, Plaintiff Leo Guy contacted Mason LLP for help. The firm responded to Plaintiff’s concerns and in turn filed a complaint in the District Court for the Western District of Washington at Seattle on Mr. Guy’s behalf.

A federal judge in Texas preliminarily approved a $2.35 million settlement against Dickey's Barbecue Restaurants Inc. This decision came after lengthy negotiations to settle this class action lawsuit between counsel for Plaintiffs (including the settlement class) and counsel for Defendant, Dickey’s Barbecue Restaurants Inc.  This lawsuit stemmed out of a data breach reported in 2020 that occurred over 100 Dickey’s BBQ restaurants.

On October 24, 2022 Judge May granted Final Approval on settlement terms Mason LLP negotiated with AspenPointe, Inc, a Colorado non-profit corporation. This settlement is related to a cyber-attack that occurred against AspenPointe. The cyberattackers were able to retrieve certain information from AspenPointe’s database containing personal identifying information (“PII”) and protected health information (“PHI”) of certain individuals. Counsel from Mason LLP spent time in lengthy negotiations with Counsel for AspenPointe to reach a fair settlement agreement for individuals affected by this data breach. Mason LLP successfully reached an agreement on behalf of Plaintiffs and Class members with AspenPointe’s defense counsel and final approval has been granted.

On October 21, 2022, Judge Roth in the District Court of Harris County, Texas granted the final approval in a class action settlement against Gastroenterology Consultants, P.A. (“GCPA”). This decision immediately followed a hearing with attorneys from both parties present.  The hearing came weeks after Mason LLP was able to come to an agreement with GCPA after continuous negotiations. Counsel from Mason LLP traveled to Houston, TX to represent Plaintiffs and Class members best interests and succeeded in doing so. The details of the settlement involved allegations from Plaintiff’s petition that GCPA failed to safeguard and protect the personally identifiable information (“PII”) and/or protected health information (“PHI”) of Settlement Class Members which caused injuries to Plaintiff and the Class.

Mason LLP's Gary E. Mason has been appointed Interim Co-Lead Counsel for plaintiffs against Eye Care Leaders Holdings, LLC. Previously in December 2021, unauthorized actors retrieved Private Information from Eye Care Leaders, a vendor of electronic healthcare records for over 9,000 eye care providers across the country, in a data breach affecting thousands of patients. As Interim Co-Lead Counsel in this data breach case, Gary SHALL assume responsibility for the following duties during all phases of this litigation, subject to further order of the Court:
