Mason LLP was the first of several firms to file a class action lawsuit against Convergent Outsourcing, Inc. After receiving a notice of a data breach from Convergent, Plaintiff Leo Guy contacted Mason LLP for help. The firm responded to Plaintiff’s concerns and in turn filed a complaint in the District Court for the Western District of Washington at Seattle on Mr. Guy’s behalf.
Defendant, headquartered in Renton, Washington, works as a third-party collection agency for companies seeking their debt collection services. This means they collect Personally Identifiable Information (“PII”) of consumers across the country from companies who utilize their services. In June 2022 ,Convergent became aware of a cyberattack on their systems where unauthorized actors successfully extracted data from their storage drive. The data extracted contained the PII of consumers whom Convergent was attempting to collect a debt from. The Defendant admitted that the files exfiltrated contained at least the following information of Plaintiff and Class Members: names, contact information, financial account numbers, and Social Security numbers.
Despite knowing Plaintiff’s and Class Members’ PII was in the hands of cybercriminals, it took more than four months for Convergent to alert them of the incident. This left over 640,000 people completely unaware and entirely vulnerable to identity theft during that time. The claims filed against Convergent include negligence, negligence per se, breach of implied contract, unjust enrichment, and declaratory judgment.
