Wright & Filippis Data Breach Class Action Settles for $2.9 Million

Oct. 13, 2023- A class of individuals affected by a 2022 data breach has requested preliminary approval from a Michigan federal judge for a $2.9 million settlement with a prosthetics and orthotics manufacturer, Wright & Filippis LLC. The settlement aims to resolve claims that the company failed to adequately protect their sensitive information from a cyberattack. The breach exposed the personal data of 877,000 individuals, including Social Security numbers, financial account numbers, health insurance information, and driver’s license numbers. The plaintiffs allege that their personal information was compromised due to the company’s negligence, and they suffered identity theft and financial losses. Under the agreement, class members can claim $5,000 in documented loss payment, credit monitoring, and insurance services, or a pro rata cash payment. Lead plaintiffs will receive $1,500. Wright & Filippis has also committed to improving data security measures. The court was asked to appoint settlement class counsel, with attorney fees not exceeding one-third of the settlement fund. The case is Braggs v. Wright & Filippis, Inc., in the U.S. District Court for the Eastern District of Michigan. Mason LLP is one of several firms representing the class.
