The order, signed by Judge Jennifer L. Rochon, consolidates two cases: Duran v. JPMorgan Chase & Co. (Case No. 1:24-cv-03514) and Walton v. JPMorgan Chase & Co. (Case No. 1:24-cv-03959). The Walton case has been administratively closed, and all documents have been transferred to the Duran case, which will serve as the lead case.
Next steps
Plaintiffs in the consolidated action are required to file a Consolidated Class Action Complaint within 20 days of the order. JPMorgan Chase & Co. must respond to this complaint within 30 days of filing. If the defendant files a motion to dismiss, plaintiffs have 30 days to respond, followed by 15 days for the defendant to reply.
The court also specified that any future related actions filed in, transferred to, or removed from this district should be consolidated under this action.
Details of the breach
A significant data breach at JPMorgan Chase compromised the sensitive financial and personal data of over 451,000 retirement plan participants. The breach, resulting from a software flaw rather than a cyberattack, allowed unauthorized access by three system users linked to JPMorgan customers or their agents. The issue, which persisted between August 26, 2021, and February 23, 2024, exposed names, addresses, Social Security numbers, and bank routing and account numbers.
