BioPlus Specialty Pharmacy Lawsuit

In Bonnie Gilbert et al. v. BioPlus Specialty Pharmacy Services, LLC, plaintiffs have filed an unopposed motion for preliminary approval of a class action settlement related to a data security incident between October and November 2021. The incident impacted approximately 350,000 individuals, exposing personal and protected health information.

The proposed settlement includes a $1,025,000 non-reversionary fund for class members whose Social Security numbers were compromised and an additional $1,175,000 reversionary fund for those whose Social Security numbers were not impacted. The settlement offers compensation for time spent dealing with the breach, reimbursement of documented out-of-pocket expenses, and additional pro-rata payments for the first group.

The case has undergone significant litigation, including a motion to dismiss by BioPlus, which was partially granted. After multiple mediation attempts, the parties reached a settlement agreement.

The motion requests the court to preliminarily approve the settlement, certify the settlement class, approve the notice plan to inform affected individuals and appoint specific attorneys as class counsel and Kroll as the settlement administrator. The settlement is considered fair, reasonable, and adequate under legal standards, and the plaintiffs seek to move forward with the final approval process.
