On December 30, 2021, Mason Lietz & Klinger LLP filed a class action against Texas ENT Specialists, a Houston-based medical service provider. The Complaint alleges that a data breach exposed more than 500,000 patients’ personal information.
Plaintiff Cliff Lee alleged that Texas ENT collected private information such as date of birth and Social Security numbers from patients, and that information was stolen when scammers gained access to the company’s computer systems for nearly a week in August 2021. The company did not notify the people whose information was stolen until December, the suit said
Lee seeks to represent all patients whose data was stolen in the breach, and made claims of negligence, breach of implied contract, negligence per se, breach of fiduciary duty, invasion of privacy, and unjust enrichment and breach of privacy. The proposed class seeks damages for any losses or expenses incurred due to identity theft, along with free credit monitoring and a court order that Texas ENT take steps to improve its information security.
The case is Lee v. Texas Ear, Nose, and Throat Specialists P.A., No. 2021-84322, in the District Court of Harris County, Texas.
